Whistler Information
Residential Zones:
Throughout most of Whistler the residential neighborhoods are zoned for “residential-use” only. Permitted uses include primary residence, residential tenancy rentals and personal recreational use. Residentially zoned property may not be rented for periods of less than 28 days, with a few exceptions for specially zoned single family homes.
Tourist Accommodation Zones:
These are areas that permit tourist rentals. It is important to note that within these areas there are two types of properties commonly referred to as Phase One and Phase Two condominiums which can also include Bed and Breakfast and Pensions.
By placing restrictive covenants (Phase I and Phase II on properties pre-designated as “Resort Land” the Municipality of Whistler requires perpetual availability and use of tourist beds near the village and mountain facilities. This guarantees a minimum percentage of units for tourist accommodation year round.
Phase I:
Unrestricted owners’ use. Ownership is a straightforward ownership system in which you own a unit in a complex outright.
These are generally one and two bedroom condo units found in “lodge” type buildings and one to four bedroom units found in “town home” type buildings. There are no restrictions on owner usage, but organized rental programs are available for those times when the owner is not using the unit.
Phase II:
These properties are generally studio, one and two bedroom apartment condos incorporated into an ongoing hotel operation. The owners’ number of days of personal usage is restricted 56 nights per year. Benefits include revenue, potential tax shelter and various hotel services and facilities. This type of unit is best suited to the occasional visitor to Whistler or for the investor interested in revenue only.
Quarter Ownership:
Unrestricted use for each of the four owners’ based on the rotation week(s) that they own, which allows use of one week per month. The rotation week depends on the week that the individual owner has purchased, every year the Christmas and New Years week rotates so that every fourth year an owner of _ share will have use of their condominium. These properties include Horstman House, Legends and Montebello II.
Unrestricted Properties:
There are some developments which have no restrictive covenants registered on title and therefore must follow the permitted uses as per the zoning.
